New Gift Card Rules

pictureAs someone who's spent a substantial amount of time brainstorming prize pools for various online and in-store promotions, I have to say that I was happy to learn of the Fed's ruling today on gift cards.

Allow me to explain. As gift cards have grown in popularity throughout the years, retailers have pedaled them as impulse purchases at checkout counters while marketing folk, including yours truly, have included them as prizes in countless sweepstakes and promotions. The reason why is simple: gift cards cast a wide net (who can't find something they like at the iTunes store or Target?) and have a high perceived value.

High perceived value, you say? How can anything that has a value of, say, $25, be worth anymore more or less than that? The answer is simple: recipients have a finite period of time to cash them in. Some never do, which is free money for retailers, while still others attempt to redeem them past their expiration dates, at which point they're forced to pay penalties of up to 50% of the card's total value. Again, another win for retailers, albeit a lowdown and dirty one.

Today the Fed said "no more".

Under the new rules, which are scheduled to take effect Aug. 22, consumers will have at least five years to use the gift cards before they expire. The Fed also ruled that service or inactivity fees can be imposed only under certain conditions. Such fees can be charged if the consumer hasn't used the card for at least a year, if the consumer is given clear disclosures about them and no more than one fee is charged a month.

What I'll be interested to see now is how companies react. My bet is we'll all have fewer chances to win dinner for two to the local Applebees, and more chances to win, for example, companion airfare tickets. After all, how many people do you know that can jet off for two days and three nights to Santa Fe, mid-week, and on short notice?
